Mainland Professional Promotion
Information on how to enter and prize details form part of these terms and conditions. By entering this Mainland promotion (“Promotion”) you are deemed to have accepted these terms and conditions.
The promoter is Fonterra Brands Australia Pty Ltd of 327 Ferntree Gully Road, Mount Waverly Victoria 3149 ABN 80 095 181 669. (“Promoter“).
To the extent of any inconsistency between these terms and conditions and any other reference to this Promotion, these terms and conditions prevail.
The Promotion start sat 12.00am AEST on Monday 16 February 2015. Entries close and must be received by 11.59 pm AEST on Monday 30 March 2015 (“Promotional Period“).
This Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram or Facebook Inc. You are providing your information to the Promoter and neither to Instagram nor Facebook Inc.
The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
Who can enter?
Entry is open to all Australian chefs. Employees and their immediate families of the Promoter and their associated agencies and companies may participate in the Promotion for the purpose of promoting the Promotion, however they will not be eligible to be awarded any prizes.
Immediate family means any of the following: spouse, ex-spouse, de-fact spouse, child or step-child (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or 1st cousin.
If you are under the age of 18 years you must have parental/guardian consent to enter the Promotion. The parent/guardian agrees to these terms and conditions of the Promotion.
How do you enter?
During the Promotional period, post a photo of a dish made with at least one Mainland Professional product as an ingredient and include the Mainland professional pack and include the name of your dish.
The Mainland Professional pack can be of any of the following: Mainland Tasty Shred, Mainland Tasty Light, Mainland Egmont, Mainland Mozzarella,
To enter you must either:
i) Answer the question as posed on the Mainland Facebook page, or additionally post a photo and include the hash tag #madewithmainland and meet any criteria required.
ii) Enter through the Ozbistro website by completing the form for entry.
Entries must be of an acceptable size, resolution and picture quality, as determined by the Promoter in its absolute discretion.Entries must not be altered or changed once they are submitted and entrants must retain a copy of any entries submitted.
Entrants may enter as many times as they like, as long as each entry is an Eligible Entry and includes a unique photo submission.
Entrants can only enter in their own name. Any entry that is made on behalf of another person by a third party will be invalid.
Entries that are incomplete, indecipherable, offensive or illegible will be deemed invalid.
Entrants must not submit any photo, image or link that contains offensive, pornographic, obscene, defamatory, threatening or abusive content or which violates or encourages violations of any law or regulations or which contains advertising or commercial messages.
Each entry will be subject to the approval of the Promoter. The Promoter may remove any entry without any notice for any reason whatsoever.
All entries and the intellectual property in them become the property of the Promoter. The Promoter may use any content (in whole or in part) from the entries including reproducing (in any media and with or without accreditations to the author) the content of any entry, for marketing or other materials. The Promoter may authorise others to use any of the rights, which it maintains as owner of the intellectual property in the entries.
Each entrant warrants to the Promoter that its entries are the original work of the entrant and that the exercise by the Promoter of its rights will not breach the rights of any other person. Each entrant warrants that they have obtained the consent of any person that is recognisable or featured in an entry (or, where applicable, that person’s parent or guardian) to submit the entry and fort to be treated in accordance with these terms and conditions.
The entrant licenses and grants the Promoter and its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual and sub-licensable right to use, reproduce, modify, adapt, publish and display the photo and information for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.
Each entrant warrants that they have complied with all applicable laws and regulations (including without limitation, those relating to copyright, content, defamation, privacy, publicity and use of third party computer and communication systems) and agrees to indemnify the Promoter against all costs and claims in connection with a failure by the entrant to comply with these terms and conditions.
Prizes and Judging
The competition is a game of skill. Chance plays no part in determining the winners. All entries will be judged individually on their merits based nonfactual correctness, creativity and originality by a panel of judges appointed by the Promoter. The best entries as determined by the judges, will win the prizes.
There are seven prizes to be won in this promotion. There are six minor prizes, and one ‘major’ prize:
a. Minor competition periods commence from time posted and ends according to the listed criteria.
Minor prize winners will be selected by a panel of judges from each week formal Eligible Entries during the promotional period. And will be awarded to the Eligible Entry within each week deemed the winner by the panel of judges. (Not sure this is that clear?)

b. The Major Prize Winner will be selected by a panel of judges from all Eligible Entries during the promotional period.
Minor Prize Winners will be announced by 5pm 2 days after each minor promotional period. The Major Prize Winner will be announced by 5pm AEST on 31 March 2015.
The Major Winner will receive $2,000.

The decision of the Promoter is final and no correspondence will be entered into.
Winners will be notified in writing via direct message on Facebook or Instagram and via email to the email address provided with their Eligible Entry, within 5 days of judging. The names of winners will also be announced on the Mainland Facebook Page. If the winner of a prize is under the age of 18 years old, the prize will be awarded to their nominated parent or guardian on behalf of the winner.
If a prize remains unclaimed after 3 months, or a winner is disqualified in accordance with these terms and conditions, the prize will be forfeited and distributed at the Promoter’s discretion.
Winners agree that their names and winning entry can be announced on Facebook, Instagram and fonterrafoodservices.com.au and the ozbistro website after they have been notified of their winning entry.
The prizes will be sent to the winners by standard delivery via Australia Post
Entrants are only eligible to win one category prize. The Promoter reserves the right to withdraw a prize if there are no Eligible Entrants to receive that prize.
By accepting a prize, you agree to participate in and co-operate as required with all reasonable marketing activities relating to the prize including but not limited to being interviewed and photographed. We reserve the right to use your comments, image and name for advertising and publicity purposes in any media in perpetuity without compensation.
A prize, or any unused portion of a prize, cannot be transferred, exchanged or redeemed for cash.
A. The Promoter reserves the right, at any time, and in our sole discretion to;
request entrants to provide proof of identity and/or proof of valid entry; and
Disqualify any entrant who we have reason to believe has breached any of these conditions or engaged in any unlawful or other improper conduct or any conduct calculated to jeopardise the fair and proper conduct of the promotion.
B. The Promoter will not be liable for any prize that may be lost, stolen, forged, damaged or tampered with in any way after it leaves our possession.
If the prize (or part of a prize) is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize (or that part of the prize) for a prize of greater or equal monetary value and/or specification.
C. If for any reason, we are not able to conduct the promotion as planned, including tampering, unauthorised intervention, fraud, any technical difficulties or any other causes beyond our control, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, we reserve the right in our sole discretion to take any action that may be available.
D. We exclude all warranties in relation to the quality, suitability ormerchantability of a prize, except those that cannot be excluded by law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any rights a consumer may have which are unable to be excluded under Australian Law, is limited to the payment of the costs of having the prize supplied again.
E. To the extent permitted by law, we are not liable for any loss (including indirect and consequential loss) or damage or personal injury suffered or sustained in connection with the promotion including the supply of goods or services by any person to the prize winners, and where applicable to any persons accompanying the prize winners. We accept no responsibility for any tax liabilities that may arise from winning the prize.
F. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook Inc. or Instagram. You are providing your information to the Promoter and not to Facebook Inc. and Instagram. The information provided will only be used for this promotion. Any questions, comments or complaints regarding this promotion should be directed to the Promoter. Each entrant indemnifies Facebook Inc. & Instagram for all costs and claims related to the entrant’s participation in the promotion or the entrant’s receipt of any prize associated with the promotion.
The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including, but not limited to, its agents, contractors, and prize suppliers. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may, for an indefinite period, also use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

In the event of war, terrorism, state of emergency, disaster or any other event beyond the reasonable control of the Promoter, the Promoter reserves the right to cancel, terminate, modify or suspend the competition or suspend or modify apprize. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of theorize) with a prize to the equal value and/or specification.
